      Regarding the current litigation, I understand that the board is to circulate an email asking the members to approve a 14th Amendment abolishing the prior three amendments adopted on the advice of the Board in 2019. Apparently the HOA’s lawyers say this will prevent any further litigation and legal expense.

      However, we have been told by Jeff Rosenthal, our board president, that Mr. Hunt has no interest in purchasing/taking over the Prospector. If that is truly the case, then why doesn’t Mr. Hunt simply drop his lawsuit?

      The proposed settlement may end the current litigation , but it certainly does not protect the HOA from Hunt’s future advances. As for curtailing its legal expense, the HOA is covered by insurance which pays for the litigation, so the monetary rationale doesn’t entirely make sense.

      Please explain why we owners would enter into a settlement agreement to abolish our protective amendments.
